A wide range of regulatory and legislative approaches to AI are being discussed in the LAC countries. Some are modelled on the EU’s Artificial Intelligence Act, which came into effect in August 2024 but which itself may be amended (see above). Some countries, such as Brazil and Chile, already have detailed proposals for legislation. Mexico and Argentina are a little further behind. Most of the largest jurisdictions in the region are following a “risk-based approach” meaning that they prohibit unacceptably risky AI applications, while setting out safeguards for higher risk ones, such as specific regulatory approval or additional disclosure requirements.
