BRAZIL: Social media companies to be held liable for content

Brazil’s supreme court (STF) ruled on 26 June that social media companies could be held liable for not actively removing harmful content. An online regulatory framework passed by congress in 2014 had obliged service providers to take down posts if a court order mandated the removal of content, but with this latest ruling, firms will be held responsible for monitoring their platforms and taking down some content even without a court order. The STF decision comes amid efforts by Brazilian authorities to update the rules governing the digital sphere, but it has fallen to the judiciary to set the regulations through court rulings, given that the legislature has been unable to pass a new framework since the 2014 law [SSR-23-07].
