PERU/BOLIVIA| CAN ruling. On 20 July, the Andean Community’s Justice Tribunal (TJCAN) ruled in favour of Peru on the lawsuit it filed against Bolivia over the higher petrol prices charged to Peruvian cargo and transport vehicles in Bolivia. The Bolivian government has long implemented differentiated prices at petrol stations for domestically registered and foreign vehicles, with the latter not benefiting from the government’s fuel subsidy. In its lawsuit, the Peruvian government argued that the price differential increased the costs of Peruvian transport firms that move across both countries, undermining their competitiveness compared to Bolivian transport firms, and that this violated the Andean Community’s (CAN) principles of non-discrimination between member countries and free competition. In its final ruling the TJCAN agreed with Peru and said that Bolivia’s conduct “violates the Andean Community’s legal system”. The tribunal has given Bolivia 90 days to adopt corrective measures. The ruling was hailed by Peru’s foreign trade & tourism ministry (Mincetur), which in a statement said that it marked another victory for Peru, noting that earlier this month the TJCAN had also ruled in its favour in a similar lawsuit filed against Ecuador.
