Bolivia: Today (19 March) public hearings begin at the International Court of Justice (ICJ) at The Hague regarding Bolivia’s case against Chile over access to the Pacific Ocean, which it lost in the 1879-1883 War of the Pacific. Bolivia’s case rests on the argument that Chile has failed to fulfil certain pledges made in the 1904 peace treaty that ended the War of the Pacific. It maintains that “the sole subject-matter of the dispute is the existence of an obligation incumbent upon Chile to negotiate in good faith Bolivia’s sovereign access to the Pacific Ocean, and the breach of that obligation”. Bolivia argues that this obligation derives from “agreements, diplomatic practice and…declarations attributable to [Chile] extending over more than a century, [that] exist independently of the 1904 peace treaty”. The hearings are due to last until 28 March.
