In brief: Mexico’s top court upholds tax claims against Salinas companies

*Mexico’s supreme court (SCJN) has rejected appeals filed by companies owned by billionaire Ricardo Salinas Pliego in relation to a series of major tax claims, ruling that the claims be upheld. In its ruling, the SCJN stated that the companies, which it did not name, had challenged tax credits determined by the federal tax authority (SAT) derived from income tax between fiscal years 2008-2013, as well as the possibility of deducting losses from the sale of shares. According to Bloomberg, the claims involved taxes worth at least M$33bn (US$1.8bn), owed by financial and retail corporation Grupo Elektra and broadcaster TV Azteca. The SCJN noted that the companies had first appealed to the administrative authority and then before the federal court of administrative justice, both of which were rejected. They then filed amparo (legal appeal) proceedings before the collegiate courts, which were denied, before turning to the SCJN. In four cases, the SCJN determined that appeals for review in tax matters could only be admitted when issues of constitutional relevance or human rights of exceptional interest were raised. In three other cases, it ruled that the appeals should not have been admitted for processing, as the issues had already been previously resolved in binding rulings. Grupo Salinas, the conglomerate owned by Salinas, issued a statement saying, “today is a dark day for justice and the rule of law in Mexico” and claiming that the SCJN had made the decision “without any legal analysis, following orders and directives from the Mexican government”. Tensions between Salinas and the government have been rising in recent months, with President Claudia Sheinbaum accusing the billionaire of abusing the amparo, a legal appeal mechanism, to delay tax payments. Tensions rose further earlier this week after the government blocked two online casinos operated by Grupo Salinas, citing money laundering concerns.
